FAST FORWARD TERMS AND CONDITIONS
Fast Forward is the business services unit for New College, Swindon.
Acceptance of Fast Forward Terms and Conditions is confirmed by an authorised purchase order
or an authorised Passport Number on a booking request.
In these terms, “days” refers to “working days” which are all days other than Saturdays,
Sundays and bank holidays.
GENERAL TERMS
Fast Forward:
- shall provide all such training, documentation and guidance as is necessary to ensure
that the delegate can reasonably expect to obtain qualifications (if any) associated with
the training course, and warrants to the delegate that the training will be undertaken
using reasonable care and skill - does not guarantee the success of the delegate in obtaining qualifications
(if any) associated with the training course, and can accept no responsibility, nor will
there be any refund of fees, in the event that the delegate fails to obtain the
qualifications (if any) associated with the training course - will accept no liability for any losses incurred in the event of any changes to government
legislation or policy - Fast Forward, its employees and agents agree to maintain as confidential, and not to use
or disclose to any third party, any information derived from the delegate in connection
with the training without the consent of the delegate except where it is necessary to
enable Fast Forward to perform its training and retain its accreditation
Fast Forward reserves the right to:
- decline the registration of any delegate it deems might have difficulty succeeding in the
training, and refund any fee that has been paid - at reasonable notice, reschedule training courses if necessary; in this case, Fast Forward
will offer an alternative date, or a full refund will be made. Fast Forward will accept no
responsibility for any abortive travel or accommodation costs - refuse admission in the event of misconduct or abusive or disruptive behaviour by the
delegate before the training course commences or during the course - refuse admission if fees are not paid and received by Fast Forward 10 days in advance of the course start date
The Customer:
- shall ensure that the training services are suitable for their needs, have read and
understood the course outline and ensure that they have a reasonable background
knowledge and expertise to understand the course material. Fast Forward urges clients
to support this policy, which is designed to protect the Customer’s investment - shall not do anything that may bring Fast Forward into disrepute.
- shall not, without Fast Forward’s prior written consent, use the names Fast Forward or
any other name used by Fast Forward or suggest an association with Fast Forward; - shall pay to Fast Forward the fees set out in the booking. These fees must be received
by Fast Forward at least 10 days in advance of the start of the training course; - except in respect of death or personal injury, will look only to Fast Forward (and not to
any individual engaged by Fast Forward , including any directors of Fast Forward ) for
redress if the Customer considers that there has been any Fast Forward breach of these
Conditions. - will be required to abide by any site rules and regulations in operation at the course
Location
TERMS FOR ALL COURSES
Confirmation of Booking
No booking will be deemed as accepted by Fast Forward unless and until confirmed in writing
and payment has been received in full unless other payment terms have previously been
agreed. All prices quoted exclude VAT.
Brochure Prices are correct at time of being published, and our most up to date prices,
together with details of any special offers, can be found on the Fast Forward website. Fast
Forward reserves the right to change the pre-booked price of a course without prior notice. Once we have received your payment or agreement to pay, we will confirm your reservation. We will post, fax or email you a confirmation package, which includes a registration
confirmation number and directions to Fast Forward’s facilities. We recommend that delegates
do not make travel and hotel accommodation arrangements without this confirmation package.
At least 10 days before the start of the course, a delegate information pack will be sent. If you
have not received this package at least one week before the beginning of class, please call us.
If information is sent to a Company’s training department, Fast Forward can not accept any
liability for information not passed to the delegate.
Fast Forward reserve the right to make changes to the course where required.
Course outlines are correct at time of publishing
Course Postponements
At times, we may change a course location, course date, or postpone a course. We will try to
give the customer as much advance notice as possible of any such change. If the customer is
unable to attend a course at the revised location or date, we will credit 100% of any prepaid
course tuition fees paid against a future course or, if requested, refund those fees. However,
we will not be liable for any other costs incurred including (for example) travel charges or any
consequential damages, even if we were advised of them.
Accommodation for Disabilities
We are committed to assisting course participants with disabilities.
Upon written request from a delegate’s employer, at least two weeks before the start of the
course, we will reserve a special space or seat in the classroom and/or additional facilities as
needed to assist any participant with disabilities or other special needs, as far as it is practical
to do so. This may include an additional set of course materials for an Auxiliary Aide at no
additional cost.
The employer of the delegate is responsible for all other costs of any necessary
accommodation, including Auxiliary Aides. Please call 01793 755552 at least two weeks before
the start of the course so that Fast Forward can arrange for the additional facilities as
required.
Copyright/Intellectual Property
All copyrights, patents, designs and other intellectual property rights in or relating to any
course materials provided or made available in connection with our courses remain the sole
property of Fast Forward. No part of any course materials may be reproduced, stored in a
retrieval system, or transmitted in any form or by any means, electronic, mechanical,
photocopying, recording or otherwise, or translated into any language, without the prior
written permission of Fast Forward.
Lost Materialss
Fast Forward shall not be responsible for the loss or theft of course materials after delivery to
the customer. Course materials will only be provided by Fast Forward as part of the purchase
of the relevant course and not as separate items of supply.
Security
The customer agrees that all delegates will abide by security measures in effect at the course
location.
Warranty
Fast Forward will use all reasonable care and skill in providing the training you order under the
agreement, including the use of suitably qualified and experienced trainers. However we make
no warranty as to the results attained by attending our courses. Furthermore, any decisions
delegates make having received our training are their own and they remain wholly responsible
for their actions.
Except as expressly represented otherwise, and to the extent not prohibited by law, all training
including any documentation provided by or on behalf of Fast Forward to the delegate is
furnished on an “as is” basis without warranty of any kind, whether express, implied, statutory
or otherwise especially as to quality, reliability, timeliness, usefulness, sufficiency and
accuracy.
Fast Forward cannot be held liable for any claim of any kind, including negligence, for any loss
or damage arising out of, connected with, or resulting from the course. In no event whatever
shall Fast Forward be liable for any incidental or consequential damages including but not
limited to damage to property, injury or death, or any other loss that may result directly or
indirectly from any of the use of the training provided by the course. Fast Forward also
disclaims any liability for delegates who incorrectly select the wrong course in error.
Indemnification
The client agrees to indemnify and hold Fast Forward harmless against any and all claims
resulting from the fault or negligence of the client or its delegates in connection with these
terms.
Force Majeure
Fast Forward shall not be liable to the client or be deemed in breach of contract by reason of
any delay or failure to perform any of Fast Forward’s obligations in relation to the course if this
was due to any cause beyond Fast Forward’s reasonable control.
We will use our best endeavours to provide the course and trainers booked. However we
reserve the right to change the content and timing of the course, presenter, date or venue.
Cancellations or changes by us for whatever reason will not result in any obligation or liability
to the client other than the prompt return of any fees paid or the issuance of a credit note in
lieu.
No Waiver
Failure or neglect by either party to enforce at any time any of provisions of this Agreement
shall not be construed as a waiver of either parties rights under this Agreement nor in any way
affect the validity of the whole or any part of this Agreement.
TERMS FOR PUBLIC COURSES
Course Tuition
The course tuition fee includes instruction, course materials, and use of software, computers
and other technical hardware as appropriate to the course. Fast Forward also provides light
refreshments during morning and afternoon and lunch unless otherwise specified. The course
tuition fee does not include accommodation, other meals, travel or any other expenses that
may be incurred by our customers.
Provisional Bookings
Course places can be reserved provisionally for up to 5 working days provided that you make
the reservation at least 20 working days prior to the course commencement. If you do not
confirm your reservation (as set out below) within 5 working days of making your reservation,
your reservation will be automatically cancelled.
Confirmation of Reservation
To confirm your reservation and enrol for the course, you must do so at least 10 working days
prior to course commencement by completing the course registration form.
Substitutions Permitted
Fast Forward welcomes the enrolment of a qualified substitute in place of another delegate,
provided the customer notifies us in writing before the course (excludes exam-based courses).
No penalty will be incurred provided these changes are made in writing at least 5 working days before
the Training start date. If a delegate wishes to make a substitution within 5 working days there will be
an administrative charge of 25% of the course fee. However, the substitute may not take
advantage of any discount programme for which he or she is not otherwise qualified.
Delegate Cancellation/Transfer
Delegate cancellations or transfers may be made and without any penalty, no later than 16
days before the first day of the course. Otherwise, once within this time period a sliding scale
of charges will apply as indicated below. For courses requiring pre-course reading packs,
cancellation fees will be applicable upon the customer’s receipt of the pre-reading pack. In the
event of timely cancellation or transfer, if the course fee has been paid, the payment may be
applied against the fees for another course or a full refund may be requested.

Transfer of the same delegate may only occur once. If the booking is subsequently cancelled,
Fast Forward reserves the right to charge the relevant cancellation charge.
Course dates may vary subject to demand. All courses will run subject to the number of
delegates. A course may be cancelled if too few bookings are received, in which case we will
notify you approximately 10 days before the course to offer an alternative date, or if you
prefer, recredit your booking fee.
In no circumstances will Fast Forward be liable for any amount in excess of the agreed fee for
the course in question. In particular Fast Forward will not be responsible for contingent travel,
accommodation or other expenses of course delegates arising from cancellation.
TERMS FOR TRAINING PASSPORTS
General
Training Passports (i) are non-transferable between companies and can only be used to pay
course tuition fees for the named company and (ii) cannot be used to attend courses either in
excess of the specified value of the Passport, unless the balance is met, or courses that start
after the Training Passport expires.
Each Passport is valid for one year from date of issue of Passport number. Training Passports
can be used by any individual within the purchaser’s organisation but must be approved by the
purchaser.
No refunds are made for training not taken or for expired Training Passports.
Passport Cancellation
If a customer purchases a Training Passport and notifies us in writing of the desire to cancel it
prior to its expiration, we will refund in full any unused Passport balance, subject to the terms
and conditions as detailed in this document. Training Passport holders who elect to use their
Passport to attend third-party certification courses may incur an additional fee to cover examrelated
expenses.
Course Tuition

fee does not include accommodation, meals, travel or any other expenses that may be incurred
by our customers.
Provisional Bookings

cancelled, Fast Forward reserves the right to charge the relevant cancellation charge.

Changes in course locations, course dates, or postponement of courses will not extend a
Training Passport expiration date.
TERMS FOR ON-SITE COURSES
We do not impose any penalty if the customer notifies us in writing of the need to cancel or
reschedule an on-site course at least 15 days before the scheduled start date of the course.
Any on-site course cancelled or rescheduled by our customer less than 15 days before the
scheduled start of the course is subject to a cancellation/rescheduling fee, as indicated below:

In the situation where a course is run exclusively for a customer – at one of Fast Forward
training centres, on a customer site or any other alternative venue – a transfer of course date
must be received in writing at least 10 working days in advance of course commencement. No
transfers are available for such courses after this period. If the booking is subsequently
cancelled, Fast Forward reserves the right to charge the relevant cancellation charge.
Fast Forward reserves the right to invoice the customer for any customer requested
requirements over and above the standard rate for the course.
Where Fast Forward is required to access the property of the delegate for the purposes of
carrying out training then the delegate’s organisation shall provide unhindered access together
with all relevant working facilities required by Fast Forward and shall provide safe access and
a safe working environment which complies with all health and safety law requirements.
GENERAL STATEMENT
These terms and conditions set out above represent a complete statement of the agreement
between the parties and supersede all prior discussions, correspondence and representations.
Our brochures and advertisements are for information purposes only and are not intended to
form any agreement between Fast Forward and the recipient. These terms and conditions are
subject to change without notice and changes will apply to any enrolment/course order
received after the date of the change. These terms and conditions may not be varied except in
a written agreement signed by an officer of Fast Forward. Fast Forward’s acceptance of a
purchase order containing different terms and conditions does not modify or supersede these
terms and conditions. This agreement shall be governed by and interpreted in accordance with
English Law.
Fast Forward limits the provision of its educational services to employees of companies,
including owner managed, partnerships and government organisations who are sponsored
by their respective organisations. This agreement is between Fast Forward and the employer.
